Mental Health Evaluation

A court-mandated or lawyer-recommended mental health assessment is an evaluation ordered by a judge to assess an individual’s mental health and provide insights that may influence legal decisions. These assessments are commonly required in cases involving criminal charges, child custody disputes, or situations where mental health concerns may impact legal outcomes.

 

The evaluation involves a thorough review of the individual’s mental state, cognitive functioning, behavior, and any relevant psychological or psychiatric history. The assessment process may include clinical interviews, behavioral observations, and review of medical or legal records. It aims to answer specific legal questions, such as the individual’s competency to stand trial, potential risk of harm to themselves or others, or suitability for certain legal obligations like probation or diversion programs.

 

The evaluator prepares a report that provides the court with an objective understanding of the individual’s mental health, diagnoses (if applicable), and recommendations that can inform legal decisions regarding treatment, sentencing, or supervision.

Alcohol and Drug Evaluation

An Alcohol and Drug Evaluation aims to thoroughly examine an individual's symptoms to identify potential signs of addiction and/or co-occurring mental health disorders. These evaluations are often mandated by the court or suggested by criminal defense attorneys or probation offices in cases involving alcohol or drug-related offenses.

               Notice of Privacy Practices & Client Rights Under HIPAA

At Breakthrough Therapeutic Services LLC, we use a HIPAA-compliant platform to manage all client records, documentation, and communications. We are committed to maintaining the confidentiality and security of protected health information (PHI) in accordance with the HIPAA Privacy Rule (45 CFR § 164.502). PHI may be used or disclosed without a client’s written authorization under specific circumstances permitted by law. These include coordination of care with other healthcare providers, emergency situations such as illness or hospitalization, when there is a serious and imminent threat to the client or others (as outlined in 45 CFR § 164.512(j)), and when required by law, such as in cases of abuse reporting or court orders. Clients are informed of these practices during the intake process through our Notice of Privacy Practices, which outlines both their rights and the limits of confidentiality.

 

Clients have several rights under the HIPAA Privacy Rule (45 CFR § 164.524–528), including the right to request and inspect or obtain a copy of their records, the right to request amendments to incorrect or incomplete information, and the right to receive an accounting of certain disclosures of their PHI. They may also request restrictions on how their PHI is used, request communications through specific channels or locations, and file complaints if they believe their rights have been violated, without fear of retaliation. To exercise any of these rights or to file a complaint, clients may contact us directly via the SimplePractice client portal or in writing. These rights are explained further in our Notice of Privacy Practices, provided during the intake process and available upon request.

 

Breakthrough Therapeutic Services LLC is legally required to maintain the privacy and security of your PHI in accordance with the Health Insurance Portability and Accountability Act (HIPAA). We use SimplePractice to securely manage all client information. Under the HIPAA Privacy Rule (45 CFR § 164.520), we are required to maintain the privacy of your information, provide a Notice of Privacy Practices, follow the terms of that notice, and notify you in the event of a breach of unsecured PHI as mandated by the HIPAA Breach Notification Rule (45 CFR §§ 164.400–414).
